The Bulk Rice Terminal is not located in the Marine Terminal as defined in Item 10 of this schedule, however, the conveyor system and loading gallery are on Pier One, therefore, except as otherwise provided, rates, rules and regulations in other sections of this schedule shall be applicable as well as provisions in this Section of this schedule on bulk rice handled through the facilities of the Bulk Rice Terminal and Pier One. |

When bulk rice is received by the Bulk Rice Terminal without first being inspected and graded by the United States Department of Agriculture and a Rice Inspection Certificate, U.S.D.A. and California Department of Agriculture Rice Inspection Certificate Form 515-067, evidencing such inspection and grade has not been furnished to the Terminal, the Terminal shall not be responsible for any particular grade upon delivery of such cargo from storage. |

ARRANGEMENT OF STORAGE SPACE IN BULK RICE TERMINAL: |

(a) |
In order to facilitate the operation and achieve maximum utilization of the Bulk Rice Terminal, the following will be considered by the Port Director in the arrangement of storage space: (1) The availability of a vessel to receive the cargo from the terminal. (2)The total storage space available and under request at the time of the request for space. (3) The storage space requirements for different types and/or grades of rice. (4) The schedule for the receiving pits to unload rice into storage. (5) The sequence of requests received by the Port for storage space. (6) Any other pertinent factors that must be considered in receiving, storing and shipping bulk rice. |

(b) |
Rice will be transferred from bin to bin whenever, in the opinion of the Port Director, such transfer is necessary to obtain the benefit of the full storage capacity of the Bulk Rice Elevator. (See Item 8130 for the rate for transferring rice) |

(c) |
Whenever, in the judgment of the Port Director, it is deemed that conditions necessitate, right is reserved to change storage space arrangements in order to meet an urgent need to receive and load a particular cargo or when conditions in the terminal will be facilitated thereby without liability to the Port of Sacramento. |

Fumigation services are not offered by the Port of Sacramento. If fumigation is performed by, or at, the request of the cargo owner, such action is at the risk and expense of cargo and owner. Any and all costs to the Port resulting therefrom shall be charged at cost plus 20%. Port labor will be charged at the applicable man hour rates herein. The Port of Sacramento reserves the right to, at its discretion, have infested cargo fumigated in order to protect other cargo from like infestation. Charges will accrue for account of cargo at the time fumigation is performed. If infested cargo is received by the terminal, the Port of Sacramento will have such cargo fumigated and such charges shall accrue for the account of the party owning the cargo at the time of delivery to the terminal. |

In addition to performing the service of cleaning dock areas, the Port will monitor vessel loading and unloading operations of bulk cargoes. The Port will approve, advise or direct modification of stevedore practices as may be required to assure conformance with pollution control standards. The Port, however, assumes no responsibility for the stevedore's compliance with all Federal, State and local laws and regulations relating to pollution control. Upon completion of vessel operations, the charges noted herein will be assessed stevedore firms for cleaning and pollution control services based on the total tonnage of cargo loaded or unloaded. |

Rates in SECTION VIII - BULK RICE TERMINAL are subject to a 4,000 ton minimum. This minimum may be filled using rice in any form, including bagged, loaded on the same vessel at the Port of Sacramento, during the same Port visit. If, on a shipment less than 4,000 tons, there are multiple parties liable for the shortfall charge, the shortfall charge will be apportioned to the respective parties on the basis of the amount of cargo supplied or contracted by each party. |
