CONTAINER, OCEAN CARRIER'S - RULES:

(a)

An ocean carrier's interchange report will be made on each container entering and leaving the Off-Terminal Storage Facilities and copies furnished by mail to the ocean carrier. A daily inventory report will be furnished by telex or fax machine to the ocean carrier indicating carrier's containers entering or leaving the Port's control.

(b)

Normal business hours for receipt and delivery of containers will be between 8:00 A.M. and 4:30 P.M., Monday thru Friday excluding Holidays.

(c)

The truck driver will release or engage the chassis when delivering or removing the container on chassis from/to the storage area. Rates and charges named herein do not include loading or unloading containers to or from chassis.

(d)

The only repair work to be performed on containers or chassis shall be of a minor emergency nature, i.e., replacing light bulbs, straightening chassis dollies, and repairing flat tires. Any such repair work that may be done by Port labor personnel shall be charged for at the man-hour rate for a mechanic listed in this schedule, plus cost of any material plus 20%. Reject containers needing, in Port's judgment, more than emergency minor repairs will be rejected and the ocean carrier or its agent notified as early as possible. Such containers will be assessed the Gate charge named herein, and the truck driver directed (if the port is so instructed by the ocean carrier or its agent) to take the container to the ocean carrier's designated repair facility away from the Port.

(e)

The Port of Sacramento shall not be responsible for any damage to vehicles, chassis, and/or containers that may occur on Port property during parking or pick-up of containers and chassis by ocean carrier, motor carrier or shippers. Port of Sacramento liability for any loss or damage to any equipment, containers or contents therein, shall be as a warehouseman pursuant to the laws of the State of California. The Port of Sacramento will maintain insurance coverage only to the extent of such liability. The Port of Sacramento shall incur no liability for its failure to perform services when prevented from performing by acts of God, fire, strikes, lockouts, or any other cause beyond its control. This provision is subject to Item 90 (e).

(f)

Containers placed on Marine Terminals as defined in Item 10 by request of ocean carrier shall be subject to marine terminal charges as provided in this Terminal Schedule No. 3.

 

 

PACKING AND UNPACKING OCEAN CARRIERS' CARGO CONTAINERS:

BULK CARGO CLEAN-UP AND AIR POLLUTION CONTROL SERVICES:

In addition to performing the service of cleaning dock areas, the Port of Sacramento will monitor vessel loading and unloading operations of bulk cargoes. The Port will approve, advise, or direct modification of stevedore practices as may be required to assure conformance with pollution control standards. The Port, however, assumes no responsibility for the stevedore's compliance with all Federal, State and Local laws and regulations relating to pollution control. Upon completion of loading or unloading operations the charges noted herein will be assessed stevedore firms for cleaning and pollution control services based on the total tonnage of cargo loaded or unloaded.

GENERAL CARGO CLEAN-UP AND REMOVAL OF OBSTRUCTIONS FROM TERMINAL AREA:

(a)

Except as specifically provided below, upon completion of vessel operations or any operation unauthorized at the Port, the Port of Sacramento will clean the work area of general cargo vessels and assess a clean-up charge to the vessel's stevedore as noted below.

(b)

REMOVAL OF STEVEDORE'S EQUIPMENT FROM TERMINAL:

Stevedore's tools, equipment, vehicles or any material or object which is not part of the cargo will not be permitted to remain on the terminal. If such obstruction is not removed within twenty-four (24) hours of vessel departure, it may be removed, stored or sold by the Port of Sacramento and the stevedore will be charged with any and all expenses incurred with such removal and sale. The Port Director is, at his discretion, permitted to allow storage of such equipment in specified places on the terminal facility or space may be leased for such purposes. Any stevedore equipment, material or object left on the terminal and not removed within the time period noted above will be assessed the charge per square foot per day or fraction Per thereof for space occupied.

STACKING OF EMPTY PALLETS BY STEVEDORE:

Upon completion of vessel operations, all empty pallets must be stacked by the vessel's stevedoring company in areas designed by the Port of Sacramento Port Director or his designee. Pallets may not be stacked or stored on aprons, against warehouses or buildings or in open areas used for cargo storage. Pallets allowed to remain in above areas will be removed by Port of Sacramento and the stevedore firm will be billed at total cost of removal plus 25%.

This item is also subject to the terms and conditions of Item 115.

Ten days free time, exclusive of Saturdays, Sundays and Holidays shall be applicable on such cargo. This Item does not apply on transshipment cargo when transshipment is substituted for the direct call of a vessel.

The vessel's agent or representative is responsible for arranging for the service of taking, letting go, and/or shifting of vessel's lines.

Linesmen will be ordered by the Port of Sacramento. The Port must receive a minimum of two hours advance notice prior to ordering linesmen. If less than two hours advance is received by the Port to call lines men, the Port will attempt to order men, but the charge will be one and one-half times the applicable schedule rate.

Line Hauling of Vessels at Berth When linesmen are ordered for line hauling, charges will be for the hours paid to the lines men at the per hour rates noted in Item 7530. A minimum of two hours per gang applies to work performed between 0800 and 1600, Monday through Friday, holidays excluded. For all other periods worked, a minimum of 4 hours will be paid and charged.

A 6-man gang will be used when vessels linehaul between hatches and use land based mooring bits.

A 7-man gang is required for line hauling at a "split" berth.

An 8-man gang will be used when linesmen must maneuver around gantry cranes or the loading towers on Berths 1 and 5.

Where services are performed for which no specific rates are shown in this schedule, the man-hour rates appearing in paragraph (b) shall be charged for the labor employed, plus the cost of any material used at cost plus 20%, plus any outside equipment rentals at cost plus 20%.

(b)

Where reference is made in this schedule to this rule, charges for the labor employed in the services furnished shall be assessed on a man-hour basis at the rates shown in the following schedule. In no case will the charges for the work performed under the man-hour rates named in this rule be less than the charges that would accrue under the application of commodity rates named in this schedule.

(c)

Where the base scale of wage is over those shown, use the next highest. All weekday shifts listed are exclusive of holidays.

Method of Determining: First, find the Occupation Description in table 1. Next to the Occupation Description is the Rate Class. Look up the appropriate Rate Class in table number 2. If the work was done on PMA shifts, look across the row labeled PMA Shift to find the proper shift in which the work took place. If the work was done on a continuous 24 hr shift, look across the row labeled 24 Hour Shift. The number under the column for the shift worked indicates the charge per hour.

RENTED EQUIPMENT, FURNISHING OF:

When the terminal is requested to obtain and/or use equipment in the course of performing services for the person or persons making such a request, and when such equipment is rented, or leased, by the terminal from an outside source, the person or persons for whose account the equipment is obtained and/or used, shall be billed the actual amount paid by the Port for such equipment plus 20%. In the event the rental or lease of the equipment by the Port is for a greater period than required to perform the service requested, the amount billed shall be the proportion of the amount paid by the Port plus 20% based on the actual time the equipment is used for the account of the party requesting the service. The charge for the labor employed in connection with the use of such equipment shall be assessed on man-hour basis at the rates shown in Item 7600. Minimum charge: The amount to be billed under this rule shall be in no case less than the amount of the charge computed at the applicable rates for the equipment or service when it is specifically provided for in any other individual item or rule of the schedule.

RENTAL AND USAGE CHARGES, BULK EQUIPMENT:

Bulk handling and stevedoring equipment is available at the Port of Sacramento bulk terminal for the stevedoring of cargoes. Stevedoring companies using any of the Port of Sacramento owned, leased or controlled equipment or services noted below will be charged the rate noted herein: Pans, spouts, flexes and/or power telescopes. Rate includes power for trimmers and other electrical equipment used.

Berth 7 Hopper (mobile equipment number 02-09) and dock belt system (mobile equipment number 02-07) are available at the Port of Sacramento bulk terminal for import stevedoring of cargoes. If the Port of Sacramento uses this system for stevedoring of cargo, the party responsible for contracting for the stevedoring will be billed.
