SECTION III - SERVICE AND FACILITIES CHARGES

DEFINITION OF SERVICE AND FACILITIES CHARGE:

Service and Facilities Charge is the charge against vessels, their owners or operators (See Note 1) which load or discharge cargo at the Port of Sacramento for the use of marine terminal working areas in the receipt and delivery of cargo to and from vessels and for services in connection with the receipt, delivery, checking, care, custody and control of cargo required in the transfer of cargo: (See Notes 2 and 3).

(a) From vessels to consignees, their agents or connecting carrier or;

(b) From shippers, their agents or connecting carriers, to vessels.

(APPLICABLE ON BULK CARGO ONLY)

Service and Facilities Charge is the charge against vessels, their owners or operators (See Note 1) which load or discharge cargo at the Port of Sacramento, for services to the vessel to enable the vessel to accomplish the transfer of cargo efficiently and with dispatch, and the use of the marine terminal working areas in connection with the movement of cargo into or from vessels. (See Notes 2 and 3)The services include the coordinating and expediting of the interchange of the commodity in a manner and in kind and quantity most suitable for the stowage or discharge requirements of the vessel, and the furnishing to vessel's representatives of statistical data in connection therewith. (See Notes 2 and 3)

Note 1:

Where the contract of affreightment (tariff, charter party, ocean rate or other arrangement) establishes the responsibility as between the parties thereto for the payment of the service and facilities charge named in this schedule, such charge shall be borne by whomsoever shall be determined to be responsible under the contract of affreightment, but the full amount of such charge shall be billed to and paid by the vessel, its owners or operators to the terminal. Allocation or adjustment of this charge between vessel and cargo shall be made solely by the parties to the contract of affreightment, in accordance with the terms of such contract.

Note 2:

Service and facilities charge does not include any cargo handling, loading or unloading operations or any labor other than that which is essential to performing the service.

Note 3:

Service and facilities charge does not include any services or facilities, the charge for which is included in wharfage, dockage, wharf demurrage, wharf storage, or other individual charges.

(a)

Service and Facilities charges (except on bulk cargo) shall be open and subject quotation as to rates and payment.

(b)

Bulk Cargo: Service and Facilities charge named in SECTION III - SERVICE AND FACILITIES CHARGES shall be applicable, except on bulk commodities handled through the grain elevator on which a Service and Facilities Charge is assessed by the grain elevator operator.

(c)

Service and Facilities Charge will apply on all cargo except clerks and labor required to check and sort cargo which vessel operator has not sorted according to steamship bill of lading at time of discharge from the vessel. Man-hour rates named in Item No. 7600 will be charged for time consumed plus charges for use of equipment.
