SECTION V - WHARF DEMURRAGE AND STORAGE

DEFINITION:

(a)

Wharf Demurrage: The charge assessed against cargo which remains on the wharf premises after the expiration of free time. (See Item No. 5200)

(b)

Wharf Storage: An alternate charge assessed against cargo which remains on the wharf premises after the expiration of free time. (See Item 5200) Wharf storage is applicable only upon prior application and acceptance of property for storage.

 

 

APPLICATION OF WHARF DEMURRAGE OR STORAGE CHARGES:

Wharf demurrage charges, as shown in Item 5800, will be assessed on all cargo remaining after the expiration of free time unless, upon prior application, the cargo is accepted for wharf storage under the following conditions:

(a)

Daily Storage: Applies for a twenty-four (24) hour period or fraction thereof. The period starts at midnight of one day to midnight of the following day. Daily storage applies and is charged all days of the week including Saturdays, Sundays and Holidays.

(b)

Monthly Storage: Except as otherwise provided in the next paragraph, shall extend from a date in one calendar month to but not including the same date of the next. If there is no corresponding ending date, it shall be the last day of the month. When the last day falls on Sunday or a Holiday, storage will be extended to the first business day thereafter.

Upon agreement between the Port of Sacramento and the owner of the cargo or his agent, a first of the month balance system may be elected wherein the Port of Sacramento will charge a full month’s storage on cargo placed in storage on or before the 15th of the month and charge one-half month’s storage on cargo placed in the storage on the 16th of the month or later. Charges for each succeeding month shall then begin with the first day of the month.

Storage Receiving and Delivery Charge: Canceled. Item 7600 is applicable where any handling to or from storage is performed.

(d)

Cargo granted monthly storage may not be transferred to daily storage.

 

 

FREE TIME:

Issued: 6/1/99

Item: 5200

(a)

Definition: The number of days during which cargo may occupy space assigned to it without being subject to wharf demurrage or storage charges.

(b)

Computation:

(1) Free time shall commence on outbound cargo at the first midnight after it is unloaded from barges, cars, trucks or otherwise placed at the Port of Sacramento; on inbound cargo, free time shall commence at the first midnight after the vessel completes discharging cargo.

(2) Free time terminates at midnight of the final day of the free time period or upon removal of the cargo from the Marine Terminal whichever occurs first.

(3) The days during the loading or discharging operations of the vessel shall not be counted as wharf demurrage days on cargo actually loaded to or discharged from such vessels.

(c)

Allowance: Unless otherwise provided, the free time allowed, exclusive of Saturdays, Sundays or Holidays, shall be as follows: (See Note and Exception.)

Note:

Cargo transshipped between vessels involving a different free time period shall be allowed the longer free time period but not the aggregated multiple free time periods.

Exception:

Outbound cargo, upon approval of the Port Director, may remain on terminal wharves, premises or facilities of the Port at owner's risk at no charge for a period of time not to exceed ten (10) working days beyond the allowable free time if the named vessel for which the cargo was originally intended is unable to call as scheduled because of stress of weather, accident, break-down or other emergency. Thereafter, wharf demurrage shall be assessed against such cargo unless or until the cargo is accepted for wharf storage. This exception does not apply to cargo which wharf demurrage or storage charges have accrued prior to the original scheduled call date of the vessel.

CARGO REMAINING ON FACILITIES BEYOND FREE TIME:

The Port Director may, at his discretion, allow cargo remaining on hand after the expiration of free time to remain where situated, to be moved within the Port or to be transferred to public or private warehouses with all expense and risk for loss and damage for the account of the owner, shipper, consignee, carrier or agent, as responsibility may appear. This provision is subject to Item 90 (e)

 

 

RIGHT TO REQUIRE INSIDE STORAGE:

The right is reserved by the Port Director to refuse outside storage when it is determined inside storage is necessary due to the nature of the cargo.

 

 

TERMINAL’S LIABILITY:

(a)

For the purpose of fixing the maximum limit of the terminal’s liability for loss of or damage to merchandise, the value of the merchandise shall be conclusively presumed to be not in excess of 11.3 cents per 0.4536 kilos (including all Government duties and excise taxes), unless a greater value shall be declared as hereinafter provided. At the time the merchandise is placed in Wharf Demurrage or Storage, the storer, subject to the provisions of Part (b) hereof may declare in writing a value greater than 11.3 cents per 0.4536 kilos, and in the event such declaration shall be conclusively presumed to be not in excess of the value so declared. In no case shall the terminal’s liability exceed the actual value of the merchandise. The limit of liability as provided in this rule shall apply separately and proportionately to each part of the stored merchandise and the liability, if any, for any partial loss of, or damage to, any part thereof shall be limited to such portion of the actual loss or damage as shall be proportionate to the limitation of liability as herein provided with respect to such part.

(b)

In the event that storer elects to declare the value of merchandise to be in excess of 11.3 cents per 0.4536 kilos as provided in Part (a) hereof, the Wharf Demurrage or Storage rate or minimum charge applicable hereto will be subject to an additional charge per day, period or month as shown in connection with applicable rate equal to ¼ of one percent of the excess value so declared. Where the value of merchandise changes after storer’s original declaration, it will be incumbent upon storer to declare a new value in writing in order to obtain a revision of charges under this rule.

 

 

TRANSFER OF OWNERSHIP:

Wharf Demurrage Charges, Storage Charges and Storage Receiving and Delivery Charges, are for the account of the cargo and any transfer of ownership after the cargo is received on the terminal will not entitle cargo to additional free time by reason of such transfer of ownership.

 

 

MERCHANDISE IN BOND:

When merchandise in bond is accepted for storage on the terminal, daily storage rates shown in Item 5840, plus 50% will apply unless otherwise provided. Any charge assessed by the Collector of Customs in connection with deliveries from bonded storage, is to be paid by the party or parties for whose account the service is rendered.

 

 

STORAGE UNDER STRIKE CONDITIONS:

Cargo which cannot be removed from the port due to a general waterfront strike of five calendar days or more, or work stoppage of waterfront labor engaged in handling cargo which curtails port operations for five calendar days or more, will be subject to the following:

(a)

Cargo on Free Time: Strikebound cargo will be continued on free time until the maximum free time allowed under this schedule has expired. The exception of Item 5200 will not be applicable in the computation of free time under the provisions of this item. Upon expiration of free time, storage charges will be assessed under the provisions of paragraph (b) of this item. Receiving and Delivery charges will not apply on strikebound cargo entering storage from free time.

(b)

Cargo on Demurrage or Storage: Cargo on Demurrage, Daily Storage, or Monthly Storage will be subject to either Daily or Monthly Storage under the storage rates in this Section, whichever results in the lowest charge during any calendar month in which the strike is in effect.

Charges Applicable after Strike Ends: Strikebound cargo remaining on hand the first day of the first calendar month following the end of the strike will be subject to Daily Storage, unless prior arrangements have been made with the Port Director for Monthly Storage.

Lumber and Medium Density Fiberboard will be allowed 30 calendar days free storage.  Beginning the 31st day, a storage charge of $0.23 per cubic meter, per calendar day. Or fraction thereof, will be charged against the cargo.  The number of cubic meters will be determined by taking the average cubic meters per pack, per Ocean Bill of Lading.
